1. Introduction
Welcome to The Wine Shop, a retail and tasting space dedicated to sharing the best of South African wine and flavour. These Terms & Conditions govern your use of our website, online store, and participation in our events and experiences. By using our site or making a purchase, you agree to these terms.
2. Use of the Website
You may browse, purchase, and interact with our site for lawful, personal purposes only. All content — including text, images, and logos — is owned by The Wine Shop or our partners and may not be copied or used without written consent.
3. Legal Age
By purchasing wine or booking an event involving alcohol, you confirm that you are 18 years or older. We reserve the right to request proof of age upon delivery, collection, or event entry.
4. Products, Pricing & Availability
All products listed are subject to availability. Prices include VAT and are displayed in South African Rand (ZAR). We reserve the right to update prices or vintages without notice. In the rare case that a selected vintage or item is unavailable, we may suggest an equivalent replacement of equal or greater value.
5. Orders & Payments
Orders may be placed online or in-store. Payment is due upon order confirmation through secure channels (Yoco, Commerce7, or EFT). Orders will only be processed once payment has cleared.
6. Delivery & Collection
Local delivery: Typically within 3–5 working days in Cape Town; national delivery times vary by courier.
Collection: Available at our Loop Street store during business hours.
Risk: Once goods are delivered or collected, responsibility passes to the customer. We are not liable for delays caused by couriers, weather, or third-party services.
7. Returns, Refunds & Exchanges
We aim to ensure every experience with us is exceptional.
Wine sales: Due to the nature of the product, we cannot accept returns for opened bottles or perishable goods. Faulty or damaged items may be exchanged if reported within 7 days of receipt.
Events: Cancellations made more than 7 days in advance may be refunded or rebooked. Within 7 days, refunds are at our discretion or may be converted into a credit for future events.
Gift cards: Non-refundable and non-exchangeable for cash.
8. Event Participation
Guests attend all tastings, pairings, and private functions at their own risk. We encourage responsible enjoyment of alcohol. The Wine Shop reserves the right to deny entry or remove anyone behaving in a disruptive or unsafe manner.
9. Private Functions & Bookings
All private or corporate event bookings require a 50% deposit to confirm and full payment 7 days before the event. Any additional services (e.g., catering, décor, or extended hours) will be quoted separately.
10. Data & Privacy
Your privacy matters to us. Personal information is handled in accordance with our Privacy Policy and South Africa’s Protection of Personal Information Act (POPIA).
11. Limitation of Liability
While we take every precaution to ensure accuracy and quality, The Wine Shop and its team cannot be held liable for any indirect loss, damage, or injury arising from the use of our website, purchases, or participation in our events — except where required by law.
12. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in a South African court of competent jurisdiction.
13. Changes to These Terms
We may update these Terms & Conditions periodically. The date above indicates the latest revision. Continued use of our services after changes constitutes acceptance of the new terms.
